Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of services provided by James Taylor / Taylor Site Design (“we,” “us,” or “our”), including website design, development, hosting, maintenance, contact form, notification, SMS alert, and related services.

By using our services, you agree to these Terms.

Services

We provide website design, development, hosting, maintenance, technical setup, contact form, notification, and related services for clients.

Specific services, pricing, deliverables, timelines, and responsibilities may be described in a separate written agreement, proposal, invoice, or service contract.

Client Responsibilities

Clients are responsible for:

  • Providing accurate business, contact, and project information
  • Reviewing and approving website content before publication
  • Ensuring that any content they provide is lawful and does not violate the rights of others or violate any applicable state or federal laws
  • Maintaining accurate contact information
  • Complying with applicable laws and regulations related to their own business and website
  • Ensuring content to be shared in the design of any website product, including but not limited to text copy and photo images, do not violate any state or federal laws

SMS Notification Program

Program Name: Twilio

Clients may choose to receive SMS notifications related to their website or services. These messages may include alerts about contact form submissions, lead inquiries, appointment requests, customer messages, status updates, or other service-related notifications. The name of the service provider used to produce SMS and email notifications is known as Twilio, and is integrated into your website’s design. Use of the SMS notification system for your website is optional.

SMS messages are sent only to clients who have opted in to receive them. Clients may opt out at any time using the website where they opted in, via the STOP command for SMS communications, or by contacting us directly at [email protected].

Message frequency varies based on website activity and selected services. Message and data rates may apply.

Consent to receive SMS messages is not required as a condition of purchasing any service. SMS opt-in consent and phone numbers will not be sold or shared with third parties for marketing purposes.

Email Notifications

Clients may also receive service-related email notifications, including project updates, support messages, contact form notifications, invoices, and account-related communications.

Website Visitor Submissions

If a visitor submits a contact form or inquiry through a website we create or manage for a client, that information may be sent to the client so the client can respond to the inquiry.

Clients are responsible for how they respond to and handle inquiries they receive through their website.

Without consent to these terms or the related Privacy Policy, we cannot and will not send communications via form submissions to you through your purchased website product, and the website would not retain any design elements for such interaction, such as related labels, text fields, radio buttons, or other design elements which facilitate communication via Twilio to you.

Payments

Payment terms, deposits, recurring fees, late fees, refunds, and cancellation terms may be described in a separate written agreement, invoice, proposal, or service contract.

Unless otherwise stated in writing, fees paid for completed work, setup, custom development, domain registration, third-party services, or other non-recoverable costs are non-refundable

Third-Party Services

Our services may rely on third-party platforms, including hosting providers, domain registrars, email providers, SMS providers, analytics tools, payment processors, or other software services.

We are not responsible for outages, pricing changes, policy changes, account restrictions, or service interruptions caused by third-party providers.

Acceptable Use

Clients may not use our services for unlawful, abusive, fraudulent, harmful, misleading, or unauthorized purposes.

We may suspend or terminate services if we believe a client’s use of the services violates these Terms, applicable law, third-party platform policies, or creates security, compliance, or operational risk.

Intellectual Property

Unless otherwise agreed in writing, clients retain ownership of content they provide, such as logos, images, text, and business information.

Ownership of custom website files, designs, code, templates, licenses, or other work product may be governed by the applicable written agreement between the client and us.

No Guarantees

We do not guarantee specific business results, search engine rankings, sales, leads, revenue, uptime, or third-party platform approval. There is no guarantee of success or lead generation in the use of any website product which is designed for you.

We make reasonable efforts to provide reliable services, but websites, messaging systems, hosting platforms, and third-party services may experience interruptions or delays.

Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

Our total liability for any claim related to the services is limited to the amount paid by the client for the specific service giving rise to the claim, unless otherwise required by law.

Termination

Either party may terminate services according to the terms of the applicable written agreement, invoice, proposal, or service contract. Cancellation of services may occur at any time from the day which the cancellation is requested, up until the last day of the month of service for that period, at our discretion.

We may terminate or suspend services at any time for non-payment, misuse, policy violations, legal risk, or other material breach of these Terms.

Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date.
